5. Right of Withdrawal (Widerrufsrecht)
5.1 EU Consumer Rights
If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
5.2 How to Exercise Withdrawal Right
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).

You may use the model withdrawal form provided on our website, but it is not obligatory.
5.3 Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
5.5 Exceptions to Withdrawal Right
The right of withdrawal does not apply to:
- Sealed goods which were unsealed after delivery and which are not suitable for return due to health protection or hygiene reasons
- Goods which are, according to their nature, inseparably mixed with other items after delivery

6. Warranty and Liability
6.1 Statutory Warranty Rights
We are liable for defects in accordance with the applicable statutory provisions, particularly §§ 434 et seq. BGB (German Civil Code).
6.2 Warranty Period
The statutory limitation period for warranty claims is 2 years from delivery of the goods.
6.3 Manufacturer's Warranty
Some products may come with a manufacturer's warranty. This is separate from and in addition to your statutory rights. Details of any manufacturer's warranty will be provided with the product.
6.4 Inspection Obligation
Please inspect your order immediately upon receipt. If you discover any defects or damage, please contact us at lumiereandhome@gmail.com within 48 hours.
6.5 Limitation of Liability
We are liable without limitation for damages resulting from injury to life, body, or health and for damages caused by intentional or grossly negligent breach of duty by us or our legal representatives or vicarious agents.
For damages caused by simple negligence, we are only liable in the event of a breach of a material contractual obligation (an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer regularly relies and may rely). In this case, our liability is limited to the foreseeable, typically occurring damage.
The above limitations of liability do not apply to liability under the Product Liability Act (Produkthaftungsgesetz).
7. Retention of Title
The goods remain our property until full payment has been received.

10. Final Provisions
10.1 Governing Law
These Terms and Conditions and all contracts concluded under them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers who are residents of the European Union, the mandatory consumer protection provisions of the country in which they reside also apply.
10.2 Place of Jurisdiction
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with contracts concluded under these Terms and Conditions is Mannheim, Germany.
10.3 Severability
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision.
10.4 Changes to Terms
We reserve the right to change these Terms and Conditions at any time. Changes will apply to orders placed after the date of change. You will be notified of any material changes.
10.5 Language
These Terms and Conditions are available in English. In case of any discrepancy between the English and German versions, the German version shall prevail for customers in Germany.

11. Information According to Battery Act (BattG)
If the products we deliver contain batteries or accumulators, we are obliged under the Battery Act (BattG) to inform you of the following:
Batteries must not be disposed of with household waste. You are legally obligated to return used batteries. You can return used batteries free of charge to our shipping address or to a nearby collection point (e.g., retailers or municipal collection points).
Batteries containing harmful substances are marked with the symbol of a crossed-out waste bin and the chemical symbol of the polluting heavy metal. These include:
- "Cd" for Cadmium
- "Pb" for Lead
- "Hg" for Mercury
12. Information According to Electrical and Electronic Equipment Act (ElektroG)
If the products we deliver are electrical or electronic equipment, we are obliged under the Electrical and Electronic Equipment Act (ElektroG) to inform you of the following:
Owners of waste electrical and electronic equipment must dispose of it separately from unsorted municipal waste. Electrical and electronic equipment that contains harmful substances is marked with the symbol of a crossed-out waste bin.
